One of the tricks that publishers use to 'copyright' PD books is to add a foreword or afterword. Or illustrations.
Maybe a short foreword or afterword about your experiences formatting the ebook, any problems that arose, choices made, etc., will be enough to be the copyrightable portion if someone copies the whole ebook without really checking it.
Now with Corbis (I think) offering free images for non-commercial purposes, maybe embedding a few Corbis images (cover anyone) in an ebook will get Corbis' lawyers involved...
Then again, I don't know if Corbis' deal is for offline use.
