It's not due to being unregistered, I've had registered kindles do that too (my Kindle3 did that a lot). It was due to the clock getting messed up. Syncing resets the clock to the time on the server. When the clock is wrong the last time read can end up earlier than the books you've already read and push the book back in the sort order.
