That's because "fair use" is outside of their rights as sellers to control. It doesn't negate my original point: They have rules (no reselling, etc) that you are expected to obey, and can be prosecuted for disobeying.

Your point is good... but ultimately it is their right as a seller to set those rules as a condition of buying their product. You are not
forced to buy the product, however... if you don't like the rules, you can walk away without suffering punishment. So maybe it isn't that "fascist" after all.
