Are you suggesting that every single time we go to buy a book, we should download a free one from that bookseller first, dig around in the acsm file, and hope for the best? That's really not a sustainable response to the question.

If you are a little concerned, buy a latest free book and check inside, so new paid books also should use the same.
wait for kobo to announce maintenance and updates, I am pretty sure they won't push a secret ninja update, they will inform all the customers and even we would know it when they update, I can post that news for you.
ultimately if kobo decides to use new drm for new books with new acs server, they must update their customers kobo readers, so everything will work fine!
also there is backward compatibility. old books can be read too on new device, reader, updated firmware.
