My understanding is that granting a stay requires either they show that damage will occur if the stay is not granted (that one seems pretty obvious unless Apple can get their money back if they win the appeal), or that there is a likelihood that the appeal will succeed (it can also be granted if it is shown that a third party will be damaged or for the public good, but I don't think either apply here). My understanding is that they look at it on a sliding scale.
