Just checked, and yes indeedy - it's an EPUB3 book.

At this point, I'm ready to make the call: EPUB3 books mean no Kobo download button, which I consider a major bug.

Does anyone else have any counter-evidence to knock down the theory?

For those who don't know what they're looking for, the *.opf file in the EPUB starts with a <package> tag, which has a "version" attribute that indicates the version of the EPUB. Most ebooks are EPUB 2.0, and those are behaving fine; the problem children are the ones that say version="3.0" instead.
