Did it do this out of the box, or have you been running it for a while? Have you added software? I'd try doing a factory reset, then confirm it's working properly. If that fixes it, try loading programs individually and testing. Be particularly careful of system utilities that "optimize" the device since they may have been written for older Android versions.
If the reset doesn't fix it, definitely take it back for a swap.
