dgbeig, were you ever able to identify exactly what tag was missing that made you re-anchor and renumber the TOC.ncx and the TOC.html?
I have exactly this problem and I cannot see why the fragment identifier in the toc.ncx file is being picked up as "missing" when it's right there in the index.xtml target file.
Unless the validators are actually broken, I guess...
