If the epub has a table of contents file (toc.ncx) with navigation entries, the first time you open the ebook, it will open at the first entry in the toc.ncx file. After you finish the book and then re-open it, it will open at the first file which very often contains the cover image.

If the toc.ncx file does not have navigation entries, the ebook will open the first time at the first file.

As near as I can tell, Kobo's ereaders only use the toc.ncx file for displaying the table of contents. A table of contents embedded in an .xhtml file is not used other than by manually navigating to that page and selecting an entry.
