The courts have gone both ways on this.

A test case is eventually going to make it to the supreme court like it did in the Betamax case. Here's hoping that it doesn't end up as close.

Right now, it depends on your jurisdiction whether or not it is legal or not, and the ruling of judges.

Even so, I reiterate my initial claim to the initial question. It is NOT fair use to space-shift in this case.
