Yes they can.
(That is how the BPHs forced them to submit to the conspiracy and how they forced them to make TTS optional, at publishers' discretion.)
They can also lodge a "valid" antitrust complaint with the Feds.
Keep an eye on Apple to see why Amazon is careful to steer clear of annoying *them*.
