True. Which is why most publishers commission the artwork (at least, for anyone they think will sell) and avoid public domain images for the most part. Hard to believe S&S would use an image that can appear on hundreds of other books (in stores and on Kindle). If they commissioned or optioned it, it's also hard to believe they would allow rights to return to the photographer so quickly.
