Nate, I don't know about Amazon being a copyright violator, but whether Google is has not yet been determined, at least not for the Google search function.
As for specific cases, I can't cite you to any anymore. It's been too many years since I practiced law but I remember this from when I did practice.
But I'm not sure that it matters -- If the MR position is that it is OK to link to Mygazines, then it should be OK to link to the Darknet. There is no difference. If it is OK for me to scan and upload my copy of The Economist, then it should be equally OK for me to scan and upload my copy of Harry Potter. I've bought both and copyright law doesn't distinguish in this regard between magazines and books.
I guess if MR approves of Mygazine then MR would have no objection to my scanning and uploading my magazines to MR for downloading. It seems to me that you can't be talking out both sides your mouth on this issue -- no to books that are under copyright but yes to magazines that are under copyright. Kind of loses any moral authority.
