Well ADE is set up for DRM so yeah they don't make things too easy
I wonder how many of the first EPUB books will be malformed in this way and how they can be detected (except for the .epub filename)?

In any case, I took a look at the Alice in Wonderland book and it's completely missing the 'mimetype' file indicating that the containing ZIP archive is in fact an EPUB ebook. If those two ADE sample books are the only "EPUB" books with with this problem, then I don't think calibre -- or other EPUB tools -- should treat them as EPUB books. You can mostly-fix them yourself by adding a file named "mimetype" containing just the string "application/epub+zip" (no newline at the end) to the ZIP archives.
