Simple solution to this.
1. Wait out the rights of the story in this case one year.
2. Warn everybody on in the Indie circuit about the publishing houses issues, if possible name the primary contact
3. Step back
In the long term Undead Press or whatever they will be called next will lose out. In the short term the Author has lost out.
Just play the long game.
