Three Publishers agreed to the settlement. That can be approved by the court well before Apple and the other two go through a trial. Those terms kick in as soon as the court accepts the settlement. I have a feeling that will happen faster then 2 years from now.
I also have a feeling that the three Publishing companies that settled provided emails and other documents to the DOJ that will be used against Apple and the remaining two Publishers.
