Yes, it is different. Piracy is not unauthorised READING; it's unauthorised COPYING. When you read the magazine in B&N you are not creating an additional copy of the magazine. There was one magazine before you started to read it; there is still one magazine after you finish reading it. It's creating the extra copy by downloading that's violated copyright law; it's entirely irrelevent whether or not you subsequently read that copy that you've created.
