Generally speaking, a book that meets one or more of the following criteria on Kobobooks.com will be non-agency:
- two prices are listed (a "List Price," and "Our Price")
- the book is very inexpensive (aka $4 or less)
- the book's price does not end in 99 cents
- the book is obviously from a small/niche publisher
Those are good rules of thumb.
