I'm not sure about the Kindle but as for the Kobo Touch I believe the only difference between the standard and ad-free versions was that the sleep and power-off mode displayed ads instead of a bookcover. So in view of that Kobo would not have not violated any agreements. It is somewhat annoying to have the recommondations and featured book lists on the homescreen however. I believe that it should belong under the "shop" page myself.
