It's entirely up to the contract between the publisher and the retailer.

OTOH, there are some very dodgy sites out there that are clearly trying to sell ebooks for which they do not have a contract in place. i.e. they take all the money and the publisher/author never sees a penny.

Give links to an instance of what you describe, and people will chime in with their opinion of the legitimacy of the shops.
