I'm quite happy that software upgrades are offered to correct known problems. Surely even your Kindle Touch cannot be considered to be 100% if landscape mode doesn't work fully. This would make PDFs unusable IMHO.

Having said this, the problems the OP reports don't sound normal. I think I'd be sending it back.
