Yes, it's illegal - or at least, it's copyright infringement (a civil matter, not a criminal one). Fan fiction is what copyright law calls a "derived work", and you can't create derived works without the permission of the copyright holder of the original work (with a few exceptions which count as "fair use"). Even when the author decides to turn a blind eye, as appears to be the case here, it doesn't alter the legality (or rather the illegality) of it.
