I have not read of this happening before. As I mentioned, about a week and a half ago Amazon started giving non-SO K3 owners the option to subscribe to special offers, so maybe they're now enabling that automatically with the software update? That seems wrong to me. We paid a premium for the non-ad version and we should be given a choice—at least the choice to unsubscribe!

Did you purchase the Kindle outside the U.S., as the customer service rep wrote? Is it registered to a non-U.S. account? If so, it's even stranger that you'd be receiving the special offers.

I'm not sure what else to suggest other than to ask for a replacement Kindle if you have had it for less than a year. A new one may do the same thing once it's upgraded to 3.3, but maybe not.
