As in the article, I do think that Penguin owes money to a lot of libraries that bought extra copies due to Kindle borrowing. It's unfair that they bought these copies now to no longer have them when they could have bought other eBooks instead.

The licenses are not format-specific, but multi-format. So while those extra lincenses can not be used to lend the books in Kindle format, they can be used to lend the book in ePub format. The only disadvantage for the libary without Kindle lending is that they have more copies of the book than are needed (which of course is an advantage for people who want to lend the book in ePub format).
