I think he's referring to the first amendment to that particular paper. The one that says "Congress shall make no law ... abridging the freedom of speech, or of the press"
Since this new one they want to pass doesn't actually abridge the freedom of speech, but only the freedom of streaming, the above mentioned piece of paper does not apply. As always whenever corporations with lots of money want something legislated.
(Yes, there was lots of sarcasm there. The "land of the free", my foot. The land of whoever has the most funds, more like.)
