As soon as I open a book, I click on the "menu" and go to the cover and go from there, so I make sure I get the TOC and any other material, grumbling (just a tiny bit) to myself as I do it.
I have gotten a few books from Amazon that opened on the TOC or at the title page, though, so it must be set whenever it's converted into the format.
