Nice idea, but considering that a lot of publishers can't even proofread/format their books properly, it seems like creating a file full of notes is going to be unlikely, especially since it's only for a subset of Kindle owners/users.

That's the first thing I thought of. It's a great idea, but the content will only be as good as the publishers make it. You're right MANY ebooks are so poorly formatted (which is crazy even still in 2011) that I can't see the x-ray sidenotes being very well done if you leave it up to the publishers.
