I'm pretty sure they have to go in the refurbished inventory once they were sold once, at least in the US.
I do know that if you return an item to be repaired, even under warranty, they can replace it with one that has been refurbished at their option.
(I have seen several Mac notebooks and iPhones that were "refurbished", and sold for cheaper. They were indistinguishable from new except the packaging. So I don't know what they do if someone marks them up or scratches them-maybe stripped for parts?)
