I suspect it depends on how brazen the selling of codes becomes. I know some of the early codes worked on any account, but now they do say you must have a KSO registered at the time you enter the code (if they do any checking before fulfilling the order, the terms clearly give them the right to charge the higher amount ... possibly even to the person to whom the code was issued, but at the very least, to the purchaser).
