Well, drm for kindle uses the kindle PID. Kindle PID are only know to amazon. So either it's mobi without drm, either it's not kindle compatible.

Amazon hasn't used Device specific PIDs for Kindle books for quite some time now, but your ultimate premise is still correct.
BTW, I'm not bitching about this... I'm genuinely curious as to how this will be achieved.
