My husband's replacement Kindle was brand new (his fell off of the roof of our car), as per the Amazon CS rep. My understanding is that the replacement I'll be getting next week, due to fading keyboard letters, will also be brand new. I did not ask whether it was a referb or not, but the CS said they were aware of the issue with some Kindles and that the "newer models" no longer have that problem.
