The guy who stole the Kindle and sold it to you robbed both you and the original owner. You file a police report (as did the original owner - which is why Amazon blacklisted it) and chalk up the experience to experience. You probably won't get your money back- that's why it is called getting robbed.

Ethics can be tricky sometimes, but not in this case.
