Don't know what the regs are like in the US these days, but in France those businesses that offer "free wifi" have to have a device that registers the identity of all customers who use the free wifi services and records what sites they visit while using the service. Not sure how long they have to keep the data, but there's a small fortune to be made in selling the boxes that record all that data.
