sorry thought it was clear from the articles but that might have been colored by my other reading on the subject since last November. The first article is actually a bit muddied.

Apple was not granted the mark. Their application was actually rejected. They responded to that rejection and the Trademark Office issued a Final Refusal.

Apple then filed an appeal called an "Application for Reconsideration". The office approved the appeal to move forward. That doesnt mean they granted the mark, only that agreed to basically re-hear the case so to speak. The next step is putting the application out for opposition - public comment if you will.

Microsoft filed in opposition to granting the mark basically restating all of the points raised by the Office when they first refused the mark and thats where it stands today.

Apple has not be granted the mark- their appeal to the refusal is pending.

Apple is suing Amazon stating that Amazon can't use the term because Apple have FILED for the mark.


Its as if I filed for the trademark Mobile Read tomorrow and filed a cease and desist to this forum's owners because they are using it after I filed the application.

If that was/is allowed by the court where the suit was filed it will set a ridiculous precedent and set off a wave of application filing and litigation that have lawyers laughing at the bank for years.
