In the sense of determining with certainty who owns land, there is nothing "messy" about it at all. There is no gap in ownership of the land...and if the Indians had given copyright by treaty, it would work the same way.

There are reasons to be opposed to copyright, but the fact that we can't keep track of it is not a reason.
