Are you asking about the forcing an upgrade part or an app breaking because of an upgrade part? No idea about the forcing part. Probably not, but they could do it if they wanted to.
As for the breaking part, the app that I work on works on iOS 4 but no longer works on 3. Different direction and we need to fix our app, but you get the idea.
And if you can provide a link or instructions on how to downgrade an iPad from iOS 4 to 3 without jailbreaking, that would be very helpful.
