The problem was that with the Kindle 2, the text-to-speech ability did not include the menu options. So, they couldn't navigate the device.

This was fixed with the Kindle 3. They also added larger fonts, for those with impaired vision.

If you are teaching a class, you're required by law to provide course materials that can be accessed by the disabled (e.g. braille books). The lawsuit claimed that the instant delivery and other ebook advantages were not available to the disabled, and thus the pilot program violated the relevant laws.
