No, they wouldn't fall afoul of agency pricing. There is a consistent misunderstanding of the agency pricing scheme.
An agency price is the
MINIMUM price at which the ebook can be sold,
not the
MAXIMUM price. That is why there are price variations among the ebooktailers.
