Depends on what the advice is and how stupid the attorney giving it is.
An Example: Bob Bonehead of Bonehead, Idiot and Stupid LLC gives free advice to his buddy at a party about not paying his child support. Now Bob is from South Carolina and his buddy is from New York. Turns out that if Bob stops paying his child support because he lost his job in South Carolina, thats ok. In New York its not. Go to jail, do not pass go stuff. But Bob has an ethical responsibility to make sure that his buddy does not act on his advice or better yet, he just shouldn't give it. If his buddy sues him, he might well win in a malpractice action of some sort, "free advice" not withstanding.
