I don't remember the details but there was one incident of an author purchasing thousands of copies of his book to make it on the bestseller list for the week. He did so to market himself as a "NYT bestselling author." He became a much more valuable commodity during his next contract negotiations.
The NYT detected this and stopped using direct online sales in their lists. It may be harder to mass purchase ebooks (or maybe not?) but it is something the NYT will have considered.

What stops the same author from walking into a book store and doing the same thing? Or pre-ordering the book at 20 different stores in mass quantities?
