It is not a requirement.
City of God for example is not on Project Gutenberg.
The issue is one of copyright. If a book is posted on PG with a note that it seems to be out of copyright in the US then it is safe to post it here. If you are sure that the book you are posting is out of copyright (as is true of all 19th century books in the US) then post it. There are many, many books that PG has yet to convert so it may be years until they get around to the ones you have converted. (If ever.)
