The whole point to the Bit Torrent protocol was to ease the load on servers through distributed downloads. When you download a parts of a torrent you don't have, you are simultaneously uploading parts you do have to other peers that need them. For practical purposes, you can't just download. (You technically can, but download speeds will be very, very poor.)

And if you are downloading illegal content, it's illegal regardless which protocol you use.
