Didn't the price and the fact that it was new in the box give you pause? I'm guessing the guy stole it from a neighbor's mailbox or front porch. When the real purchaser discovered its delivery status as "delivered," the purchaser would have reported that to Amazon and they would have sent a replacement and flagged this one. I doubt you have any recourse, as you're not likely to find the guy, and even if you did, you've got nothing to show for the purchase (he's not legit, so it's your word against his).
Why wouldn't you just order a legit one from Amazon?
