yes you can use notes and highlights for non-kindle ebooks (not purchased from Amazon) but those notes/highlights will not be backed up on the Amazon servers and you won't be able to synch the notes/highlights between a kindle and other kindle apps.
This has never been an issue with me and I make quite a few notes.
