Now if a Nook is a gift, as long as the giver includes a "gift receipt", it's still covered by the warranty.
And yes, the warranty on a Kindle transfers. But the one-year standard warranty doesn't include accidental damage. So unless the seller had an extended warranty with accidental damage coverage, you'd be in the same boat. (Although they seem to be a bit more lenient these days with the broken screen policy, maybe they had a bit of a surplus of refurbs with the K3 coming out.)

No, I *said* that they choose to neither honor the warranty *OR* even allow for a fee-swap if the person making the request is *not* the original owner-of-record.
And *both* are problems in our legal system. If there is an outstanding warranty left on the device/item, then B&N needs to honor it. If the device/item is past warranty, then B&N *should* offer the same swap-for-refurbished-unit-for-a-fee that other ereader companies do.
