So what you're saying is you bought a Nook knowing it was broken, but didn't bother to check into whether the warranty would transfer or not. Ever hear of caveat emptor? I just picked up a Nook on eBay too. I'm getting a Square Trade warranty for it because I'd checked and found out that the one-year warranty doesn't transfer. I agree that it's cheesy not to have it transfer.
Now if a Nook is a gift, as long as the giver includes a "gift receipt", it's still covered by the warranty.
And yes, the warranty on a Kindle transfers. But the one-year standard warranty doesn't include accidental damage. So unless the seller had an extended warranty with accidental damage coverage, you'd be in the same boat. (Although they seem to be a bit more lenient these days with the broken screen policy, maybe they had a bit of a surplus of refurbs with the K3 coming out.)
