This means they must have accessed his kindles files remotely.This means they can read all your private files and copy them and distribute them,delete them,sell them or pass them to police.
K3 can't read .rtf files directly, but you can easily convert them, either yourself using a program like calibre or stanza or by e-mailing them to Amazon.

Yes, the K3 has a mic. The most reasonable current speculation (IMO) is that it may allow spoken annotation of documents in a future firmware update. If you buy a K3 expecting to use it as a free phone at Amazon's expense, I think you will be setting yourself up for disappointment.

Amazon backs up only those documents you bought from Amazon. You have to back up your private documents yourself.

Yes, theoretically Amazon could read your private files, if you send your private files to Amazon for conversion or transfer, or if you leave Whispernet turned on. If this makes you uncomfortable a Kindle is still useable with Whispernet turned off--or you might consider one of the multitude of fine readers that do not have this issue.

To carry really private stuff like your bank break-in plans I would frankly recommend paper, written out by hand, and burned promptly when you don't need them anymore. You might consider some kind of cipher--I understand the Julian cipher is a classic, but there have been great strides taken in recent centuries.

Oh look everybody! A new species of Kindle FUD! As a (reluctant) connoisseur of Kindle FUD I have to say the child porn is a new refinement that adds considerably to the toxicity of the mix.

I suppose it is technically possible that Amazon could do this. It would be commercial suicide, but it could happen that Amazon decides to wipe itself out in a self-destructive public relations holocaust. If you're worried about it, I recommend you cancel your Amazon order immediately and look into one of the many fine readers made by companies like Astak or CyBook.
