actually the exceptions are being granted with respect to the DMCA. apple (and other companies) attempted to use the DMCA to make it illegal to jailbreak your phone. the copyright office has now said that the DMCA can not be used in these cases. doesn't mean companies can't get congress to "fix" the law, pass a new one making it illegal, or take the whole matter to court to get a different "interpretation" that is more favorable to them.
