There were better phones than the iPhone going back to 2003. And there were good, but very expensive and heavy Windows tablets, Fujitsu being the most notable producer.

Apple's innovation was dumbing down the devices. Apple's brilliance was reducing functionality to make them simpler to use and fit the available hardware at the time. SJ's marketing genius is undeniable.

Apple loses in Japan

Quote:
Apple Inc. lost a patent lawsuit in Japan as a Tokyo judge ruled that Samsung Electronics Co. smartphones and a tablet computer didn’t infringe on an Apple invention for synchronizing music and video data with servers.

Apple was ordered by Tokyo District Judge Tamotsu Shoji today to pay costs of the lawsuit after his verdict, the latest decision in a global dispute between the technology giants over patents used in mobile devices. Samsung shares rose, erasing earlier losses.

“It’s hard to believe the products belong to the range of technologies of the claimant,” Shoji said in dismissing Apple’s case.

Have you read the information about why the Jury reached the decision they did? I found this interview with the jury foreman very convincing:

Quote:
One of the most decisive pieces of evidence was reading the minutes for myself of a meeting that was held at a very high level between Google executives and Samsung executives.

It was for a tablet and Google was concerned that for the sake of their operating system that the look and feel and the methodology that they [Samsung] were using to create their tablet was getting too close to what Apple was doing.

And in the memo themselves - remember this was minutes - they stated that Google demanded that they back away from that design.

And later there was a follow-up memo among themselves, these executives, and in black and white it says: we elect to not pass this information down to the divisions that were actually involved in the design.

So, from the sake of the engineers they went merrily along continuing their design not given any orders to back away.

They knew nothing of that meeting. To me that kind of raised a light bulb in my head that when I got in the jury room I wanted to read the minutes of that meeting myself.

That doesn't sound like "bully tactics" to me; it sounds like Samsung deliberately acting in a way that Google themselves were very unhappy with.

The daft thing about that Google email and this trial is that as you say the jury were very swayed by it. Sure looks like a smoking gun.

But let's look a little closer at this email, shall we?

Quote:

It was "for a tablet".

The email is about the look and feel of the Galaxy Tab vs the iPad.

And yet the jury ruled that the Tab did not infringe on the iPad's design.

So why was this taken as a smoking gun for the phone infringements?

The UI on the iPhone and the iPad is exactly the same. Do they differ between Samsung phones and tablets?

Now yes, back then we were talking about Froyo or Honeycomb, so they were much more similar. However, the emails talked about 'design of the front side', which suggests at least some concern regarding hardware rather than just UI.

But that's not the point: the jury ruled that there was no infringement here. It's inconsistent.

How is leaving out multi-tasking capabilities and interface customization NOT dumbing things down? Apple is telling users: "you can't be trusted to use the full functionality of your devices responsibly, just let Big Daddy handle it for you so that you don't mess up". If all people didn't need it, why did they provide multi-tasking for their own apps? Why is interface customization so popular with Android users? Why are the pen and multiple windows making a comeback?

Some of the simplifications did make sense in 2007-2009, but now hardware has progressed beyond the limitations of that time.
