This suit was brought by states AG so let's hope all the $ goes to consumers. Those lawyers are salaried.

I don't think the settlement applies outside state that were in the settlement, which means Minnesota and non-US state customers may be out of luck.

No you have read correctly. There have been son changes, a few of the big 5 have settled with the courts, as part of the settlement they where required to let Amazon and other booksellers go back to the retail model.

Those that are fighting the DOJ still have the agency model intact.


Example go look on Amazon for a book published by Random House (who is using the Agency model) say "Payback" " by Phil Town. Under the price you will see it listed as "Price set by distributor. Now look for a book that is not in the Agency Model say "Princess Bride" or "Hunger Games ". You'll see both of these are reduced and no mention that the price was set by the vendor.

I hope so too.
I am sick of seeing class action lawsuits where the victims get pennies on the dollar and the Lawyers walk away with millions.

That has always been the case.
Not all publishers adopted Agency--and Amazon for one refused to accept it from the smaller publishers.

The Settlement has been agreed to but it won't go into effect until after the court signs off. For now the existing Agency contracts are still in place.

According to Publisher's Weekly:

• Backlist gets $0.25 per book
• Frontlist but not best seller gets $0.36 per book
• NYT Bestsellers get $1.32 per book
• If it's unclear, $0.30 per book

They also pointed out that "97% of all sales came from Amazon, B&N, or Apple."

If you're eligible, you will receive a notice. You can specify a check, or decline to receive a payment. If you don't respond to the notice, you'll get some kind of credit from the retailer. E.g. if the settlement owes you $15, and you bought 1/3 your books from B&N and 2/3 from Amazon, it sounds like you'll get a $5 credit at B&N and $10 at Amazon.

I.e. if you receive a notice and want a check, make sure to carefully read and respond to the notice.

The settlement is still pending court approval, so it could be modified or changed. If approved, it will still take months for this to all go through.

This is also not a class-action lawsuit where private attorneys receive 50% of the settlement. It was filed by the states, who primarily used their own legal resources.

I'm getting...well, I don't know how much but it's a lot for a group lawsuit like this. Something like $15 for 2010 alone (which is when I got tired of counting)

Payback is agency and non-discountable just like always. The other two can be discounted because Houghton Mifflin Harcourt and Scholastic are non-agency publishers and never have been. I know how to tell the difference, but don't see what you're trying to say by the example you're giving.
